AL fan Downing's lawyers: "ain't no crime, he was just joshin'"

Unbelievable.

I know this is only tangential to the BCSNCG or even college football, but it seems relevant enough to share.

Someone ask those lawyers if they'd get as far with that argument if the victim was a woman or a child. This is going to backfire on them in a big way and Downing and, by extension, AL fans are just going to look like neanderthals to the rest of country. Hell, it'll probably end up tarring LSU and SEC schools. Of course, ESPN will do a special hour long film directed by Morgan Spurlock on unruly fans and out of control football programs in the South, spending half the film on the Shady's bar fight and showing all the useless cell phone footage they can get their hands on. And next thing you know Rush Limbaugh will have Downing on the show to talk about how it's a shame that men can't just show their johnsons whenever they want, much like dogs can go around without underwear, the irony will be lost on all of them, and the real crime will get lost in the misleading fog of disinformation.

You think he would have done it if it was a woman or child? I don’t.

They aren’t saying that it wasn’t a crime, but I would agree that treating him as a sex offender is a bit ridiculous. No way this guy should do serious time. Maybe some days or months, a heavy fine.

Definitely.

Teabagging to some people is a prank that you pull on your buddies when they pass out. Yes, it’s gross and immature. It’s a ridiculous act. But even among people that would be inclined to do that kind of thing, I don’t think they would view it acceptable to do it to a woman or child. And yes, he showed a lack of judgment in doing it to a stranger in public, but I think it would take a lack of judgment on a whole other level for him to do it to a woman.

This was about humiliation, just like many sexual assault crimes are. I’m not saying the guy deserves to be locked up for 20 years, but this is a pretty serious scenario.

Support him and Updyke? No, but what I will say is that a good portion of Bama fans coming forward are to defend him not being a sex offender and playing this off as big deal it was a prank. And I’m sure you’ve seen all the pictures of bama fans posing to take pics with Updyke like he was a celebrity. Its making the good portion of your fan base look classless

And I’ll say I meant that the good portion of bama fans that are speaking are defending it in some degree. Now the second time I mentioned good portion I meant as in the good fans are getting a bad name from the other portion defending his behavior as a prank. As no doubt it must piss off fans like you to see this type of behavior from some of your fan base. Also I know this whole situation could be reversed and some of our fans would be vocal about it not being a sex offense and they too would be wrong. But Bama fans have a bad track record recently with this and Updyke.

Two totally different situations. Paterno never molested anyone. That Bama fan was caught on tape violating a passed out man. So I guess if Paterno would have been caught on film molesting kids and the penn state fans still supported him then yeah I’d say there was something wrong with that fan base too.

this and Updyke just affirms that belief. Something is definitely wrong with any fanbase that claims almost double the amount of national championships they have when the real number is already amazing. The culture of cheating that is part of Alabama’s history adds to this as well (although I don’t think Saban is cheating).

I don't want that to happen to him, but sometimes it happens in those places...

If he does time, I hope he just serves it without something like that happening to him. Regardless of how it turns out, maybe he won’t go around just joshin’ next time and understand what he did was quite serious no matter how it stacks up to other crimes.

Prosecuting this fool to the fullest extent of the law will only serve to galvanize the fringe elements of both LSU and Alabama fanbases, and that’s the last thing we need.

Actions have consequences.

A minimal jail sentence wouldn’t be any more of a burden on an overcrowded system than the NOPD arresting someone for having a joint in his or her pocket. I’m not advocating the guy to go away for much longer than say 30 days to reinforce that actions have consequences. Again, it is not socially acceptable to rub your genitals on someone in public, drunk, sober or otherwise.

Correct me if I'm wrong, but I don't believe this guy has been prosecuted yet

only charged. And I’m fairly certain district attorney’s aren’t going to come out and say “it’s okay, we’re only going to ask for probation here” in a case like this, regardless of the sentence they’re seeking.

this is the most shocking thread i've ever read on this site

if it was up to you people a lot of my friends (most of which are successful family men with no criminal records) would all be doing hard time for some of the things that happened at 4am after someone made the mistake of passing out too early. y’all should have gotten out more in your early 20’s. did all these people commenting actually go to lsu?? i feel like i’m reading a thread on [whatever the clever name for byu’s sbn site is].

Is that someone who broke a law should deal with the punishment associated with that. So when you say “if it was up to you people a lot of my friends would be doing hard time..” it’s not like we’re crusading for the death sentence for someone who litters. The guy broke a law, and the attached punishment could be being labeled a sex offender. Actions have consequences, and this is a pretty disgusting action.

i don't know if i was misunderstood

so much as there is some selective reading going on. everyone seems extremely focused on me trying to explain that this type of behavior is more common than a lot of you apparently realize…albeit by drunken college students. i agree with everyone that if you’re 32, and married with kids, and in public, and on camera, etc, etc…then you can’t be doing something completely asinine like this. however, in my opinion, that also doesn’t mean this dude should be a registered sex offender as some people are saying. i think we all agree that what happened was a crime to some degree, but the punishment is where we differ. since everyone clearly had their torches and pitchforks ready to go before i got here…go ahead and fry his ass…what do i care.

It kind of chaps me because the rest of us poor schleps have to stand by what we type. I’m not calling for an edit function for regular users because I believe that online should be just like real life; you have to be held responsible for what you say, or in this case type. Enough people saw it and commented – both against as well as in support of – that no one can deny it happened, but you can’t find that part of the thread any more. go look around the internet and find any number of Bama fans defending Saban and Bama for how they treated the Philon kid and oversigning in general.

you want to get into oversigning when LSU is in the same boat as Bama. Your assessment of Alabama and it’s fans is wrong at best. I’m not going to debate the rematch for the Title because what’s really the point? I had no control in the selection process and neither did you, none of us did. So why should we feel bad for winnning the Title game? LSU had been the “laughing stock” at the start of the season because they were winning. That’s what happens, when a program is on top people will do whatever they can to knock them down a notch. Just like you are doing by lumping all Bama fans into one section and turn a blind eye to all things LSU.

Didn't an LSU signee arrive on campus a couple of years ago to find out he had no scholarship.

You had no problems with Miles oversigning or Saban, for that matter. As long as you win championships.

Since its a clear cut case of sexualy battery by definition, now they might plead down to lesser charge and all this sex offender argument goes away. But the dude was sexually assaulted and over a million people saw it in the Internet. You think he feels Downlin or whatever his name was should just make an apology and get little as possible time served? But like many times people forget about the victim(s) and only talk about the offenders rights.

I honestly don’t understand why people think he shouldn’t be classified as a sex offender. Sexual battery carries a consequence with it, and part of that consequence is being a registered sex offender. Is this guy a sex offender? Go back and watch the video again. He assaulted a person who was so drunk they were passed out. Period.

When your first thought upon seeing an unconscious person, regardless of gender, is that you want to sexually batter them, you have problems. End of story.

People trying to defend this as a prank are just as guilty as the idiots who stood around and cheered him on and didn’t stop this while it was happening.

The reason for all of these "sex offender" laws

is that a lot of your sexual deviates are compelled to repeat their crimes. Your serial rapists, molesters, etc. Sex offender laws are there to protect the public from those kinds of criminals. But you end up with a lot of people lumped into this category that really don’t need to be. This teabagger or some 18 year old kid that has consensual sex with a 17 year old are lumped in with your Jerry Sanduskies. That’s what I don’t like about this whole “sex offender” thing.

Hmm. If it was a choice between the teabagger and a random non-white collar criminal from whatever prison he gets sent to, I would choose the teabagger for sure.

I think this guy’s an idiot, and if his punishment is wearing that tag for the rest of his life, so be it.

I will say that your scenario of the 18 year old kid having consensual sex with his 17 year old girlfriend is ridiculous, and it’s incredibly sad that the law covers them too.
